Bill Gates was not indicted in the Netherlands

A Dutch court ruling that it has jurisdiction to hear civil claims against Bill Gates regarding COVID vaccines has been mischaracterized on social media as Gates having been “indicted” in the Netherlands.

Some of the social media posts point to the Dutch court decision from Oct. 16 in a document, opens new tab hosted on a blog site, opens new tab, neither of which mentions any criminal charges or an indictment for Gates.

One post on Facebook, opens new tab said: “Bill Gates indicted and ordered to stand trial in the Netherlands for misleading the public about Covid19 vaccines.”

 

The narrative stems from remarks, opens new tab by Robert F. Kennedy Jr. at a rally for Donald Trump in Georgia on Oct. 23, where he said Gates was “indicted in the Netherlands for lying to the public about the Covid vaccine”.

But Gates has not been indicted in the Netherlands, a spokesperson for the Bill & Melinda Gates Foundation said in an email.

The narrative refers to a civil case brought by seven Dutch plaintiffs alleging that Gates and others individually and as a group deliberately misled them about the safety and effectiveness of COVID vaccines, according to the case summary in the English-language jurisdiction decision document linked in the posts.

 

Gates’ attorneys had disputed the Dutch court’s jurisdiction because he does not reside in the Netherlands. The plaintiffs argued that jurisdiction claim should be dismissed.

The official decision about jurisdiction can be found on the court website, opens new tab in Dutch, which said the court does have international jurisdiction over the “American co-defendant,” referred to as “X.”

The contents of the document in English shared online, which mentioned Gates by name, match the decision on the court website.

 

The verdict is about Gates, a spokesperson for the Court of Northern Netherlands told Reuters in an email.

Because the court has jurisdiction over one of the defendants, and the case involves alleged unlawful acts by a group in which Gates is a participant, the court also has jurisdiction over Gates, the court ruling said, citing the Dutch Code of Civil Procedure, opens new tab.

The court dismissed Gates’ dispute and ordered him to pay the associated legal costs, the decision said, adding that the main case can move forward.
